1- Purpose and acceptance of the general conditions

The Florêve Paris site (hereinafter referred to as the "Site") is an e-commerce site accessible via the Internet at www.floreveparis.com It is open to any user of this network (hereinafter referred to as "User").

The Site allows Florêve to offer cosmetic products for sale to Internet users browsing the Site (hereinafter referred to as "Users"). For the purposes hereof, it is agreed that the User and Florêve shall be collectively referred to as the "Parties" and individually referred to as the "Party", and that the User who has confirmed an order shall then be referred to as the "Purchaser". The User's rights and obligations necessarily apply to the Buyer.

Any order for a Product offered on the Site requires the consultation and express acceptance of these general terms and conditions of sale, this acceptance however does not require a handwritten signature on the part of the User.

It is specified that the User may save or print these general terms and conditions of sale, provided however that they are not modified.

Florêve reserves the right to modify these General and Specific Terms and Conditions of Sale at any time, without notice, it being understood that such modifications shall not apply to reservations and orders previously accepted and confirmed by the Purchaser.

These conditions apply to the exclusion of any other document.

2- Products marketed on www.floreveparis.com

All product offers on the Site are limited to Metropolitan France and Corsica.

"The Purchaser may, prior to his order, take note of the essential characteristics of the product or products he wishes to order on the Florêve Site.

Offers to purchase, including promotional offers, are valid as long as they are announced on the Site."

3- Prices of the products for sale on the site

The prices appearing on this Site are indicated in Euros all taxes included and are subject to variation during the year, it being understood that the products ordered are invoiced at the prices in force at the time the order is placed.

They do not include shipping costs, which are invoiced in addition to the price of the products purchased according to the amount of the order. Shipping costs will be indicated before the order is confirmed by the Buyer.

Prices include the value added tax (VAT) applicable on the day of the order and any change in the applicable rate will automatically be reflected in the price of the products sold by Florêve on its Site.

4- Orders

Any order implies unrestricted and unreserved acceptance of these general terms and conditions of sale.  

The Purchaser accepts that Florêve's order recording systems are proof of the nature of the agreement and its date.

The amount of each order is limited to the sum of 1,000 Euros per order.

When the order is confirmed by clicking on the “Complete order" button, the Purchaser declares that he accepts the order and these general terms and conditions of sale. The order form can be printed.

As soon as the order is recorded, a detailed acknowledgement of receipt will be sent to the Purchaser at the email address indicated by him. This acknowledgement of receipt will specify the exact amount invoiced and the delivery terms of the order. 

This acknowledgement of receipt implies acceptance of the order and will validate the transaction subject to payment of the order.

Should one or more products ordered be unavailable after placing the order, you will be notified by e-mail. The amount of your order will be recalculated and you will be charged the new amount, minus any missing products. If your order is completely unavailable you will be notified by email and you will not be charged.

. If Customer Service informs you that the order has already been processed, you will not be able to cancel it: you will then have to refuse the package upon receipt of your order. 

Florêve reserves the right, however, to suspend or cancel any order from a Purchaser with whom there is a dispute relating to the payment of a previous order, or for any other legitimate reason relating in particular to the abnormal nature of the order.

5- Payment

All orders are payable in Euros.

The Purchaser can use the following payment method to settle the order: Paypal.

The Purchaser guarantees to Florêve that he has the necessary authorizations to use the payment method he has chosen, when confirming the order form. 

Florêve reserves the right to suspend or cancel any order and/or delivery, whatever its nature and level of execution, in the event of non-payment of any sum due by the Purchaser or in the event of a payment incident.  

Penalties equal to the legal interest rate plus five points are automatically applicable to unpaid amounts after a period of ten days following the invoice date.

As regards the fight against Internet fraud, information relating to your order may be referred to any competent authority for verification.

6- Order delivery

The products will be delivered to the address indicated by the Purchaser on the order form, according to the delivery method chosen from the methods described on the Shipping/Delivery page. Delivery will be made within an average period of 2 to 7 days from the receipt of the order form, depending on the delivery method chosen and at most within 30 days from the receipt of the order form

7- Legal guarantee

The Purchaser benefits from the provisions of the legal warranty of conformity pursuant to Articles L. 211-4 et seq. of the Consumer Code and the legal warranty against hidden defects pursuant to Articles 1641 et seq. of the Consumer Code.

Should the product be found not compliant, in particular due to an anomaly or error in the references delivered, the Purchaser may choose to return the product to Florêve and obtain a refund.

The return shipping costs will be refunded by Florêve at the Purchaser's request.

8- Right of withdrawal

"The Purchaser has 14 clear days from the date of receipt of the product to return the ordered products for refund at his own expense.

Refund will be made by any means of payment the Purchaser chooses after using his right of withdrawal, no later than 14 days following the date on which the right is exercised (upon receipt of the returned order or proof of shipment of the returned product)."

9- Instructions for returning products

Products may be returned by the Purchaser under the following conditions and instructions:

We accept the return of any item purchased on the site if it is returned within 14 days of the date of receipt of the order by the Purchaser.

We invite the buyer to attach to his shipment the Return Form which he will find attached to his order or available here, in order to make it easier to process the return.

The refund concerns all sums paid on purchase, including delivery costs. It should be noted that under Article L. 121-21-4 of the Consumer Code, only standard delivery costs will be covered (amounts corresponding to express or special shipments will not be covered).

The Purchaser shall bear the shipping costs of the return package. In the case of a technical anomaly or an error on the references delivered, the return shipping costs will be refunded.

The product must be intact, in its original state, in its packaging, with its accessories and instructions. It must not have been used.

If a box or set is to be returned, you must send the entire box or set.

In special cases of impaired texture or fragrance or intolerance we invite you to contact us in advance by phone on {l s='Custom phone number :' d='Shop.Theme.Menu'} or by email at contact@floreveparis.com. A specific return procedure will then be communicated to you.

Whatever the reason for returning the products to Florêve, it is advisable for the Purchaser to follow the following instructions in order to make it easier to process the return:

"Use the original unopened product packaging to return the product. "

Complete and attach the Return Form to be detached from the Delivery Note.

The Purchaser shall remain liable for any risks linked to returning the product.

10- Retention of ownership

Florêve retains full and complete ownership of the products sold until full payment of the price, in principal, fees and taxes included.

11- Liability

"Florêve cannot be held liable for the non-performance of the contract in the event of a stock shortage, except for price promotions not intended to sell the stocks, or in the event of unavailability of the product due to a case of force majeure. "

Florêve accepts no liability:

for any service disruption;

for any bugs;

"for any damage resulting from fraudulent intrusion by a third party leading to a change of the information made available on the site; "

and more generally any direct or indirect damage, whatever the cause, origin, nature or consequences, including in particular loss of profits, customers, data or any other loss of intangible property that may occur as a result of anyone's access to the Site or the impossibility of accessing it or the credit given to any information directly or indirectly from it.

12- Intellectual property

In accordance with the laws governing the ownership of literary and artistic rights or other similar rights, this Site and all elements, trademarks, designs, models, photographs, texts, illustrations, logos, animated or not, sound or not, graphics etc. found on this site as well as their compilation are the exclusive property of Florêve, which does not grant any license or any other right than that of consulting the Site. The reproduction, or the use of all or part of these elements is only authorised for the exclusive purpose of information for personal and private use, any reproduction and any use of copies made for other purposes is expressly prohibited. Neither the Site (in whole or in part), nor its content, nor the trademarks may be used, reproduced, duplicated, copied, sold, resold, made accessible, modified or exploited in any other way, in whole or in part, for any purpose whatsoever without prior written authorization from Florêve. Any other use constitutes counterfeiting.

13- Information technology and Freedom

The information collected is intended for Florêve and its service providers in order to process the Customer's order and send, unless the Customer objects, information on Florêve's products and services, perform customer relationship management (CRM) operations and/or manage the Customer's membership of the loyalty program. The Customer has the right to access, rectify, oppose and delete data concerning him/her at Florêve by contacting Customer Service.

14- Applicable law

Florêve's product sales are subject to French law.

15- Mediation

The Purchaser is informed of the possibility of using consumer mediation for any disputes that may arise regarding the sale of Florêve products. Referral to the mediator is only possible if the Purchaser has already contacted Customer Service and has not received a response or satisfaction to his complaint. The European Commission offers a one-stop shop for consumers and professionals wishing to resolve disputes arising from online transactions out of court.
